Commercial Contracts

Website terms and conditions and online trading

The world wide web is a fantastic tool, it opens up enormous opportunities for businesses, and in many ways it is far less formal than traditional business methods. There are nevertheless certain rules - some specific to the online environment and others which apply to trading generally – which you need to observe.

For example, regulations such as the E-Commerce Regulations 2002 require all websites to provide certain information and a privacy policy should cover what information you will collect from and about users of your site and how this information will be used.

If you are selling online the requirements are more detailed. For example you must have a returns policy and requirements will be different depending whether you are selling to consumers or businesses. If you are selling outside the UK you may also need to comply with the regulations of other countries around the world.

It is also important that you understand when a contract is made on the web or you could find yourself in difficulty as Argos did a few years ago when someone updating their website entered the price of a TV as £3.99 rather than £399.

If you are setting up a website, whether you will be trading online or simply creating an online presence, take advantage of our free initial telephone appointment to discuss your plans.
